1. Agreement to Terms

By accessing or using Belgian Tax Calculator ("the Service"), you expressly agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you must not use the Service.

Your agreement to these Terms and our Privacy Policy is confirmed when you:

  • Access or browse the website.
  • Create an account or log in.
  • Subscribe to our newsletter.
  • Purchase or activate a paid subscription.
  • Import transaction data or use any feature of the Service.

These Terms apply to all users, including visitors, registered users, newsletter subscribers, and paid subscribers. By performing any of the above actions, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy in their entirety.

2. Description of Service

Belgian Tax Calculator is a web-based tool designed to help Belgian investors calculate their tax obligations, including but not limited to:

  • TOB (Taxe sur les Opérations de Bourse / beurstaks).
  • Dividend withholding tax (roerende voorheffing / précompte mobilier).
  • Capital gains tax on financial instruments.
  • ECB exchange rate conversions for foreign-currency transactions.

The Service imports transaction data from supported brokers and generates tax reports to assist users with their Belgian tax filing.

Belgian Tax Calculator is a calculation tool only. The Service does not constitute tax advice, legal advice, or financial advice of any kind.

Although we do our best to stay up to date with all the latest tax rates, regulations, and Belgian tax laws, we do not guarantee the accuracy, completeness, or timeliness of the calculations, rates, or information provided by the Service. Tax laws and rates are subject to change, and there may be delays between legislative changes and updates to our system.

You, the user, are solely responsible for:

  • Verifying the correctness of all calculations produced by this tool.
  • Ensuring the accuracy and completeness of the data you import.
  • Cross-checking all tax amounts, rates, and deadlines before filing.
  • Consulting with a qualified tax professional, accountant, or lawyer before submitting any tax declarations to the Belgian tax authorities (FOD Financiën / SPF Finances).

Belgian Tax Calculator accepts no responsibility or liability for any errors, omissions, or inaccuracies in the calculations, or for any financial loss, penalties, interest, or other consequences resulting from the use of this Service. Use of the Service is entirely at your own risk.


Reporting issues: In the event that you discover any incorrect data, outdated rates, or other inaccuracies on our website or in our calculations, we would be happy to investigate and correct them. We encourage all users to report any issues they encounter by contacting us at support@belgiantaxcalculator.be.

We are committed to ensuring that our Service and the information on our website is as accurate and up to date as possible at all times. In the end, our goal is to help our subscribers navigate their Belgian tax obligations with confidence.

4. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Providing accurate and up-to-date personal information.
  • Notifying us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

5. Subscription and Payments

Some features of the Service require a paid subscription. By subscribing, you agree to the following:

  • Pay the applicable subscription fees as displayed at the time of purchase.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • We may adjust pricing with at least 30 days' prior notice.
  • All prices are displayed in euros (EUR) and are inclusive of applicable VAT.

6. Refund Policy

6.1 Monthly Subscriptions

Monthly subscriptions are non-refundable. You may cancel your subscription at any time, and you will continue to have access to the Service until the end of your current billing period. No partial or pro-rata refunds are provided for unused portions of a monthly subscription.

6.2 Annual Subscriptions

Annual Pro subscriptions include a 30-day free trial period. You may cancel at any time during the trial period at no cost. After the 30-day trial period ends, annual subscriptions are non-refundable. No partial or pro-rata refunds are provided for unused portions of an annual subscription once the trial period has ended.

6.3 Third-Party Professional Consultations

No refunds for professional consultations

Belgian Tax Calculator does not provide refunds, credits, or compensation of any kind for costs incurred by the user in connection with consultations with external tax professionals, lawyers, accountants, or any other third-party advisors. This includes, but is not limited to:

  • Fees paid to tax advisors or accountants for verification of our calculations.
  • Legal fees for advice related to your tax obligations.
  • Costs of professional assistance with filing tax returns.
  • Any other professional services obtained in relation to the use of this Service.

As stated in our Legal Disclaimer (Section 3), users are strongly encouraged to consult a qualified professional before submitting tax declarations. However, the cost of doing so remains solely the responsibility of the user.

6.4 How to Request a Refund

To request a refund (where eligible), contact us at support@belgiantaxcalculator.be with your account email and the reason for your request. Eligible refunds will be processed within 10 business days to the original payment method.

7. No Professional Advice

The Service is provided as a self-service calculation tool. Nothing in the Service, its reports, or its documentation should be interpreted as:

  • Tax advice or tax planning recommendations.
  • Legal advice of any nature.
  • Financial or investment advice.
  • A substitute for professional consultation with a qualified Belgian tax advisor, accountant (boekhouder / comptable), or lawyer (advocaat / avocat).

We strongly recommend that you consult with a qualified professional before making any tax filing decisions based on information provided by the Service.

8. Accuracy of Data and Rates

The Service uses the following external data sources to perform its calculations:

  • ECB exchange rates, sourced from the European Central Bank for currency conversions.
  • Belgian tax rates, TOB rates, dividend withholding tax rates, capital gains tax rates, and exemption thresholds as published by FOD Financiën.
  • Security classifications, for determining correct TOB rate categories.

While we make commercially reasonable efforts to keep these rates and data current, we do not warrant that they are always accurate, complete, or up to date. Legislative changes, ECB publication delays, or technical errors may cause temporary discrepancies. You must independently verify all rates and calculations before relying on them for tax filing.

9. Limitation of Liability

To the maximum extent permitted by Belgian and EU law, Belgian Tax Calculator, its owners, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or savings.
  • Financial penalties, interest, or fines imposed by tax authorities.
  • Errors or inaccuracies in the tax calculations produced by the Service.
  • Loss of data, or costs of data recovery.
  • Costs of procuring substitute services.
  • Unauthorised access to or alteration of your data.
  • Any third-party conduct on or related to the Service.

In no event shall our total aggregate liability exceed the amount you have paid to Belgian Tax Calculator in the 12 months preceding the claim.

10. User Responsibilities

By using the Service, you agree to:

  • Provide accurate and complete information when importing data or entering transactions.
  • Use the Service only for lawful purposes and in compliance with all applicable Belgian and EU laws.
  • Verify all tax calculations, reports, and amounts before filing with the Belgian tax authorities.
  • Consult a qualified tax professional for your specific situation before filing.
  • Not attempt to reverse-engineer, decompile, or circumvent any security measures of the Service.
  • Not share your account credentials with others.
  • Keep your imported financial data and generated reports confidential.

11. Intellectual Property

The Service and its original content, features, functionality, design, and code are owned by Belgian Tax Calculator and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written consent.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any violation of these Terms. Upon termination:

  • Your right to use the Service will immediately cease.
  • Any outstanding subscription fees remain payable.
  • You may request export of your data within 30 days of termination.

13. Indemnification

You agree to indemnify, defend, and hold harmless Belgian Tax Calculator, its owners, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use or misuse of the Service.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Any inaccurate, incomplete, or misleading data you provide to the Service.
  • Any tax filing, declaration, or payment made based on the Service's output.
  • Any dispute between you and a third party (including tax authorities, accountants, or lawyers) related to your use of the Service.

This indemnification obligation survives the termination of your account and these Terms.

14. Acceptable Use Policy

You agree not to use the Service in any way that:

  • Violates any applicable Belgian, EU, or international law or regulation.
  • Involves scraping, crawling, or automated extraction of data from the Service.
  • Attempts to gain unauthorised access to systems, accounts, or data.
  • Interferes with or disrupts the integrity or performance of the Service.
  • Resells, sublicenses, or commercially redistributes the Service or its output (including generated reports) without our prior written consent.
  • Uses the Service on behalf of third parties without a valid business subscription that permits such use.
  • Attempts to reverse-engineer, decompile, or disassemble any part of the Service.
  • Introduces malicious code, viruses, or other harmful content.

We reserve the right to suspend or terminate your access immediately if we reasonably believe you are in violation of this Acceptable Use Policy.

15. Data Accuracy Obligation

The accuracy of the Service's calculations depends directly on the accuracy and completeness of the data you provide. You acknowledge and agree that:

  • You are solely responsible for the accuracy, completeness, and correctness of all transaction data, broker statements, and other information you upload or enter into the Service.
  • Belgian Tax Calculator does not verify the accuracy of your input data and accepts no liability for calculations based on inaccurate, incomplete, or misleading data ("garbage in, garbage out").
  • You must review all imported data for errors before relying on the Service's calculations.
  • Discrepancies between the Service's output and your actual tax obligations may result from data entry errors, missing transactions, unsupported transaction types, or broker-specific formatting issues.

16. Data Access for Technical Support

By using the Service, you acknowledge and agree that Belgian Tax Calculator may access and review your account data, including imported transactions, portfolio information, and generated reports, solely for the purpose of:

  • Investigating and resolving technical issues reported by you or detected by our systems.
  • Assisting with support queries related to data imports, calculations, or report generation.
  • Diagnosing errors, bugs, or unexpected behaviour in the Service.
  • Verifying the correct functioning of our tax calculation engine.

This access is limited to authorised Belgian Tax Calculator personnel and is carried out strictly on a need-to-know basis. We will never sell, share, disclose, or transfer your data to any third party for any purpose, except where required by law or court order. Your financial data remains confidential and is treated in accordance with our Privacy Policy and all applicable GDPR provisions at all times.

17. Force Majeure

Belgian Tax Calculator shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or public health emergencies.
  • War, terrorism, civil unrest, or government actions.
  • Internet or telecommunications failures, cyberattacks, or DDoS attacks.
  • Server outages, cloud infrastructure failures, or hosting provider issues.
  • Failures or outages of third-party services (ECB data feeds, Stripe payment processing, Auth0 authentication, database hosting).
  • Changes in applicable law or regulation, including retroactive changes to Belgian tax law.
  • Power failures or utility outages.

In the event of a force majeure, our obligations under these Terms will be suspended for the duration of the event. We will make commercially reasonable efforts to resume normal service as soon as practicable.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any subscription-specific terms presented at the time of purchase, constitute the entire agreement between you and Belgian Tax Calculator regarding the use of the Service. These Terms supersede all prior or contemporaneous agreements, communications, representations, and understandings, whether written or oral, relating to the subject matter hereof.

20. Waiver

The failure of Belgian Tax Calculator to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Belgian Tax Calculator. A waiver on one occasion shall not be deemed a waiver on any subsequent occasion.

21. Assignment

  • We may assign, transfer, or delegate any of our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.
  • You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section shall be null and void.

22. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Belgium.

23. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice within the Service at least 14 days before they take effect. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
